Terms & Conditions

Hayley Hoani Music

These Terms & Conditions apply to all services provided by Hayley Hoani Music, including (but not limited to) weddings, private events, bars, restaurants, corporate events, and public venues.

1. Bookings & Confirmation

A booking is confirmed once:

  • The booking is accepted in writing (email, message, or invoice), and

  • The required booking fee has been paid.

Once confirmed, the date is reserved exclusively for the client and removed from availability.

2. Booking Fee / Deposit

  • A non-refundable booking fee is required to secure all bookings

  • No booking is held without payment of the booking fee

  • The booking fee is deducted from the total performance fee

The booking fee covers administration, preparation, rehearsal, and loss of opportunity should the booking be cancelled.

3. Balance Payment

  • The remaining balance is due prior to the performance date, or on the day by prior arrangement

  • Failure to pay the balance may result in cancellation of services, with cancellation fees still applicable

4. Client Cancellations

If the client cancels the booking for any reason, the following applies:

  • Booking fee: non-refundable in all circumstances

  • Cancellation within 14 days of the event: 50% of the total booking fee payable

  • Cancellation within 7 days of the event: 100% of the total booking fee payable

This applies regardless of whether the event proceeds with another supplier or is cancelled entirely.

5. Weather-Related Cancellations

Weather is considered a foreseeable risk, particularly for outdoor events.

  • Cancellations due to rain, wind, temperature, or adverse conditions are treated as standard client cancellations

  • No refunds are provided for weather-related cancellations

  • Clients are responsible for arranging suitable wet-weather contingencies where required

6. Venue or Third-Party Cancellations

If a venue, organiser, council, or third party cancels or closes the event:

  • The booking is still considered a client cancellation

  • All cancellation terms and fees apply in full

7. Postponements & Date Changes

  • Date changes are subject to availability

  • If the new date is unavailable, the booking is treated as a cancellation

  • Booking fees remain non-refundable

At the discretion of Hayley Hoani Music, a booking fee may be transferred to a new date if sufficient notice is given.

8. Additional Requests & Fees

Any requests made outside the original booking agreement may incur additional fees.

This includes (but is not limited to):

  • Extended performance time

  • Additional sets or encores

  • Special song requests not previously agreed

  • Changes to the performance schedule

  • Additional equipment or setup requirements

Any additional fees will be discussed and agreed at the time of the request.
Where agreed, these fees are payable immediately or added to the final invoice.

Hayley Hoani Music reserves the right to decline additional requests that are not feasible or have not been agreed in advance.

9. Performance Times

Performance start and finish times are based on the agreed booking schedule.

  • Late starts caused by the client, venue, or third parties do not extend the agreed finish time

  • Any extension beyond the agreed finish time is subject to availability and additional fees

10. Authorised Contact Person

For events with multiple attendees, the client must nominate one authorised contact person.

  • All requests, changes, or approvals during the event must come from this person

  • Hayley Hoani Music is not responsible for conflicting or unauthorised requests from guests or third parties

11. Noise & Volume Restrictions

Performance volume may be adjusted to comply with:

  • Venue requirements

  • Council or noise control regulations

  • Safety considerations

No refunds or fee reductions apply where volume restrictions are imposed.

12. Performance Conditions

The client is responsible for providing:

  • A safe and suitable performance space

  • Access to power where required

  • Adequate protection from weather for outdoor events

Hayley Hoani Music reserves the right to suspend or cease performance if conditions are unsafe or equipment is at risk.

13. Damage to Equipment

The client is responsible for ensuring that guests, staff, and third parties do not interfere with or damage equipment owned by Hayley Hoani Music.

Any loss, damage, or theft of equipment caused by guests, staff, venue personnel, or third parties during the event will be the responsibility of the client.

The cost of repair or replacement may be charged to the client where damage occurs due to negligence, interference, unsafe conditions, or lack of adequate protection.

14. Artist Cancellation

In the unlikely event Hayley Hoani Music must cancel due to illness or circumstances beyond reasonable control:

  • All fees paid will be fully refunded

  • Liability is limited to the amount paid

  • No further compensation is payable

15. Force Majeure

Neither party shall be liable for failure to perform due to events beyond reasonable control, including natural disasters, government restrictions, or emergencies.
Where possible, rescheduling will be offered.

16. Acceptance of Terms

By confirming a booking and paying the booking fee, the client acknowledges they have read, understood, and agreed to these Terms & Conditions.

Wedding & Private Event – Additional Conditions

The following conditions apply in addition to the above Terms & Conditions for all wedding and private event bookings.

17. Event Timing & Delays

Performance times are based on the agreed booking schedule.

  • Delays caused by the client, guests, venue, celebrant, or third parties do not extend the agreed performance or coverage time

  • Any extension beyond the agreed schedule is subject to availability and additional fees

18. Schedule Changes on the Day

  • Minor timing adjustments will be accommodated where reasonably possible

  • Significant changes that affect performance time, sets, or equipment may incur additional fees

  • Hayley Hoani Music is not responsible for reduced performance time due to schedule overruns outside its control

19. Special Song Requests & Preparation

  • Must be agreed in advance

  • May incur additional preparation or rehearsal fees

  • On-the-day requests are subject to availability and additional charges

20. Guest Requests & Alcohol

  • All requests must come through the nominated authorised contact person

  • Requests from guests or third parties will be politely declined unless approved by the authorised contact

21. Equipment Placement & Guest Safety

The client and venue are responsible for ensuring:

  • Equipment is kept clear of high-traffic areas

  • Children and guests do not interfere with equipment

  • Food and drinks are kept away from equipment

22. Outdoor Events & Weather

  • A suitable wet-weather backup plan is required

  • Weather-related interruptions do not qualify for refunds

  • Adequate protection from rain, wind, and sun must be provided

If conditions are unsafe, performance may be paused or ceased without refund.

23. Photography & Videography

  • Performance positioning and equipment placement remain at the discretion of Hayley Hoani Music

  • No responsibility is accepted for missed footage or photographs due to performance or equipment requirements
